Terms of Use

These terms apply to your use of BodyKit, an iPhone app by Kramer Ventures GmbH, Hagenholzstrasse 81, 8050 Zürich, Switzerland ("we", "us"). They add to Apple's standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which applies to every app downloaded from the App Store. By using BodyKit, you agree to both.
1. Health and fitness disclaimer
Please read this section before you start training.
- Not medical advice. BodyKit is a general fitness app. It isn't a medical device, and it doesn't diagnose, treat or prevent any condition. Nothing in the app, including plans, coach messages, posture scores and the "body read", replaces advice from a doctor or other qualified professional.
- See a doctor first before you start any new exercise program or change your weight, especially if you are pregnant or recently gave birth, are over 40 and haven't been active, or have a heart condition, high blood pressure, diabetes, joint, back or other injuries, or any other medical condition.
- Stop if it hurts. Stop exercising straight away and get medical help if you feel pain, chest tightness, dizziness, faintness, unusual shortness of breath or nausea. Exercise at your own level and rest when you need to.
- Estimates, not guarantees. Scores, your "potential", calorie counts, rep counts, weight projections and target dates are estimates made by simple calculations and on-device camera tracking. They can be wrong. Results depend on you, your body, your diet, your sleep and many other things, and we don't promise any particular result.
- Weight goals. BodyKit flags targets below a healthy weight for your height, but this check is basic. If you have, or have had, an eating disorder, please talk to a healthcare professional before setting a weight goal.
- Train safely. Clear the space around you, use a stable surface, and put your iPhone where it can't fall or be stepped on. Keep your surroundings in mind when your attention is on the screen. If you use equipment such as dumbbells, check that it's in good condition and suitable for you.
- Minimum age. BodyKit is for people aged 16 and over. If you're under 18, use it with the agreement of a parent or guardian.
2. The app
We give you a personal, non-transferable right to use BodyKit on Apple devices you own or control, under Apple's EULA. You may not copy, modify, reverse-engineer or resell the app, except where the law allows it.
BodyKit stores your data only on your device (see the Privacy Policy). You're responsible for keeping your device and its backups safe. If you delete the app or restart onboarding, your data is gone, and we can't recover it.
We may update, change or stop offering the app or any feature. We'll try to keep it working well, but we can't promise it will always be available, error-free or compatible with every device.
3. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the Swiss Product Liability Act (Produktehaftpflichtgesetz).
For slight negligence, we are liable only if we breach an essential contractual obligation (one that the proper use of the app depends on and that you may rely on). In that case, our liability is limited to the damage that was typical and foreseeable when the contract was made.
Otherwise, we aren't liable. Your statutory consumer rights are not affected.
4. Apple
These terms are between you and Kramer Ventures GmbH, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
5. Changes
We may update these terms, for example when we add features. The current version is always at https://facekitapp.com/bodykit/terms/. If a change is significant, we'll point it out in the release notes.
6. Law
These terms are governed by Swiss law. If you're a consumer living elsewhere, this doesn't take away the protection given to you by the mandatory laws of your country of residence. Mandatory statutory rules on jurisdiction apply.
